Rules & Regulations

1. Contest is open to individuals, except employees and immediate family of Orchard Park Shopping Centre Holdings Inc. by its manager, without personal liability, Primaris Management Inc. (“Orchard Park”) and their affiliates and their advertising and promotional agencies and persons with whom they are domiciled.
2. No purchase necessary to enter. Contest closes on April 18, 2010 at 11:59 p.m..
3. By entering this contest, entrants consent to the use of their names, and/or photographs for publicity purposes without compensation.
4. Contest entrants may enter by entering online at http://www.orchardparkshopping.com/fresh. Limit of one online entry per person for the Grand Prize during the contest period. Limit of one digital photo of merchandise from Orchard Park can be uploaded for the Secondary Prize draw per person, per day during the contest period. A total of 10 bonus votes towards the Grand Prize draw will be awarded for each digital photo of merchandise from Orchard Park uploaded onto the contestant’s profile. All digital photos not taken within Orchard Park Shopping Centre will not eligible for the Secondary Prize draw or the 10 bonus votes towards the Grand Prize.
5. One Grand Prize of $5,000 in Orchard Park gift certificates is available to be won. Twenty Eight Secondary Prizes of $100 in Orchard Park gift certificates are available to be won.
6. All prizes will be awarded on April 20, 2010. Winners will be chosen by top voted entries, voting is limited to one person per day.
7. Winners will be notified by email and/or telephone with further instructions on how to claim his/her prize. If the selected entrant cannot be located or does not respond within 10 days of notification, the entrant forfeits the prize and the prize will be awarded to an alternate entrant.
8. Orchard Park, the sponsors and their advertising and promotional agents assume no liability for lost, stolen, delayed, damaged or misdirected entries or for any problems or mechanical or technical malfunction of, or damage to, any computer online systems, servers, access providers, computer equipment, software, or failure of any entry to be received by Orchard Park for any reason, including on account of mechanical or technical problems or traffic congestion on the Internet or at any website, or any combination thereof for damage to an entrant's or any other person's computer or for breaches of privacy due to interference by third-party computer "hackers." The sponsors reserve the right, in their sole discretion, to cancel or suspend the Contest should a virus, bug or other cause beyond the reasonable control of the sponsors corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of the Contest is a violation of criminal and civil laws, and should an attempt be made to do so, the Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. All entries are subject to verification and will be declared invalid if they are illegible, incomplete, forged, falsified, altered or tampered with in any way.
9. The Contest is void where prohibited by law and is subject to Federal, Provincial and Municipal laws and regulations.
10. Entrants eligible to receive a prize will be required to sign a declaration confirming understanding and acceptance and compliance with the contest rules and acceptance of a prize and a release satisfactory to Orchard Park before being declared a winner. All prizes will be awarded in the form of Orchard Park Gift Certificates.
11. Orchard Park, in their absolute discretion; reserve the right to make substitutions of equivalent kind or value in the event of the unavailability of any component of the prize for any reason whatsoever.
12. Orchard Park shall not be held accountable or responsible for misdirected phone calls, interruption in telephone service, busy signals and/or any other difficulty in contacting a contestant by phone.
13. Orchard Park reserves the right to discontinue the contest or alter the rules at anytime. Orchard Park reserves the right to remove any entry deemed inappropriate without prior notice.
14. By accepting the prize, the winner agrees to hold Orchard Park, their affiliates, subsidiaries, sponsors, advertisers, advertising and promotion agencies their respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of use of the prize. Winners assume all liability for any injury or damage caused, or claiming to be caused, by participation in this promotion or use or redemption of any prize. By participating in this promotion, entrants agree to be bound by the official rules and the decisions of the judges.
15. Personal information collected from entrants will be used by Orchard Park for the purpose of administering this contest. By entering this contest, you consent to the manner of collection, use and disclosure of personal information.
